In mediation, Mr. Clement acts as a neutral third party to help you and your spouse or co-parent work through your disagreements. The goal is a Parenting Plan or property settlement agreement that avoids litigation. A mediated solution is almost always quicker, less costly and less stressful than going to court. It allows you to control the outcome to a greater extent and it reduces future conflicts.
Every case is unique, but mediation can help to resolve Parenting Plan disputes in most cases. We handle pre-filing mediations between couples who want an amicable, low-cost divorce. We also handle mediations in contested divorce and custody cases when mediation is a pre-condition to trial, or when mediation is required prior to filing a petition to modify an existing Parenting Plan:
- We provide half-day (morning or afternoon) or full-day mediation sessions, depending on your timetable and the complexity of your case.
- We also provide a mediation-to-arbitration arrangement. If both parties agree, Mr. Clement serves as a mediator in the morning to help bring parties to resolution. At noon, he switches to an arbitrator who issues a definitive ruling on any issues still unresolved.
- In cases which involve substantial assets or complicated parenting issues, Mr. Clement can schedule mediations lasting several days.
Bruce Clement also handles collaborative law, a negotiation process in which you each have a lawyer to protect your interests but agree in writing not to litigate.
