What is a collaborative divorce?

Many people have heard of mediation, a form of alternative dispute resolution (ADR) that we use frequently in our offices and discuss frequently on our blog.

However, that is not the only type of ADR that is available for divorcing couples. While mediation is adequate in many cases, sometimes it is not the perfect fit.

In those cases, or when couples prefer a different approach, collaborative divorce is an option for them to settle their cases out of court with assistance from their attorneys.

What is a collaborative divorce?

Collaborative divorce is another ADR approach that focuses on cooperation and mutual respect. In Washington State, this approach allows couples to work together to find solutions that work for them while receiving assistance from a variety of trained professionals, all to reach a fair and amicable settlement.

In a collaborative divorce, each spouse retains a collaborative attorney who will guide them through the process and ensure that their interests are presented clearly and adequately.

In addition, this type of ADR allows other professionals, such as financial advisors, child custody specialists, and others, to help the couple reach an agreement.

One of the best parts of a collaborative divorce is that the process promotes a healthy post-divorce relationship between the parties, which is especially important when children are involved.

In Washington, collaborative divorce is an excellent option for couples who seek to settle their divorce outside of court but still want the active participation of their attorneys and other trained professionals.
